Thus, the following terms will mean:<\/p>

Buyer \u2013 natural person \/ legal person or other legal entity that issues an Order.<\/p>

Seller \u2013\u00a0SC SXP WINTER SRL<\/strong>, with the trade name\u00a0SC SXP WINTER SRL<\/strong>, having its registered office in Lupeni Municipality, Straja recreational area, building II, no. 9, CUI 46644239, registration number with the Trade Register J20\/1310\/2022.<\/p>

Goods \u2013 any product, including the documents and services mentioned in the Order, to be provided by the Seller to the Buyer.<\/p>

Order \u2013 an electronic document that acts as a form of communication between the Seller and the Buyer, by which the Seller agrees to deliver the Goods and the Buyer agrees to receive these Goods and make payment for them.<\/p>

Contract \u2013 an Order confirmed by the Seller.<\/p>

Intellectual Property Rights \u2013 all intangible rights such as know-how, copyright and rights in kind, database rights, design rights, model rights, patents, trademarks and domain name registrations for any of the above.<\/p>

2.Contractual Documents<\/h1>

By placing an electronic Order on the website https:\/\/strajaextremepark.ro\/, the Buyer agrees to the form of communication (e-mail, telephone) through which the Seller conducts its operations. The Order will be composed of the following documents:<\/p>

The order (along with clear mention of delivery and billing dates) and its specific conditions.<\/p>

If the Seller confirms the Order, this implies full acceptance of the terms of the Order. The acceptance of the Order by the Seller is considered complete when there is an electronic confirmation (e-mail) from the Seller to the Buyer, without requiring a confirmation of receipt from the latter. The Seller does not consider an unconfirmed order to have the value of a Contract at any time.
The Order confirmation is made electronically (e-mail). The prices of the products in the order are valid for 3 working days from the date of registration of the order. The general terms and conditions of sale will form the basis of the Contract thus concluded.<\/p>

Product descriptions may be incomplete, but the Seller makes efforts to present the most relevant information, so that the product can be used within the parameters for which it was purchased;<\/li><\/ul>

                The price, payment method and payment term are specified in the Order. The Seller will issue an invoice to the Buyer for the delivered Goods, the Buyer's obligation being to provide all the information necessary for issuing the invoice in accordance with the legislation in force.<\/p>

                For correct communication of the invoice related to the Order, the Buyer is obliged to update the data in his Account whenever necessary and to access the information and documents related to each Order existing in the Account.<\/p>

                By sending the Order, the Buyer expresses his\/her agreement to receive invoices also in electronic format via e-mail, to the e-mail address mentioned in his\/her Account.<\/p>

                10. Responsibilities<\/h1>
                • SELLER<\/strong>undertakes to ship the Goods and Services via door-to-door courier to the Buyer.<\/li>
                • SELLER<\/strong>is released from the risks and responsibilities associated with the Goods and Services upon their delivery to the domestic courier company with which\u00a0SELLER<\/strong>\u00a0collaborates or to the Buyer's representative.<\/li>
                • SELLER<\/strong>will ensure the proper packaging of the Goods and Services and will ensure the transmission of accompanying documents.<\/li>
                • SELLER<\/strong>cannot be liable for damages of any kind that the Buyer or any third party may suffer as a result of the performance by the\u00a0Seller<\/strong>\u00a0of any of its obligations under the Order and for damages resulting from the use of the Goods after delivery and in particular for the loss of the products.\u00a0SELLER<\/strong>\u00a0will be liable if its subcontractors and\/or partners of any kind involved in the execution of the Order fail to fulfill any of the contractual obligations.<\/li>
                • SELLER<\/strong>does not assume responsibility for the descriptions of the products presented on the site. The images are presented on the site as an example, and the delivered products may differ from the images and descriptions displayed on the site in any way, due to changes in features and design without prior notice.\u00a0SELLER<\/strong>\u00a0reserves the right to complete and modify any information on the site without prior notice.<\/li>

                • Value<\/strong>maximum obligations\u00a0seller<\/strong>\u00a0towards any customer in the event of non-delivery or improper delivery is the value of the amounts collected by the Seller from the respective customer.<\/li>
                • The products sold on the site are intended for personal use, and their resale is strictly prohibited, according to the Fiscal Code.<\/li><\/ul>

                  11.Product delivery<\/h1>

                  Delivery\u00a0not<\/strong>\u00a0is free and is done by express courier as described in the "Deliveries" section.<\/p>

                  Our products are sometimes made to order, which means that the production and delivery time can be up to 14 business days from the day the order is processed.<\/p>

                  Orders are processed as soon as possible after placing the order, between Monday and Friday 10:00-18:00. Orders placed outside of business hours (Monday-Friday 10:00-18:00) or on weekends will be processed on the first business day. On holidays and during sales periods, delivery times may be extended.<\/p>

                  If the package cannot be delivered (the recipient does not respond, the address you specified is incorrect, etc.), you will be contacted by phone by the courier. If the recipient cannot be contacted, the packages remain with the local courier for 7 days, after which they are returned to the Sender.<\/p>

                  We are not liable for delayed shipments, loss, destruction, damage, non-delivery or misdelivery of a shipment or part thereof if they are caused by the following situations\/circumstances beyond our control, but not limited to:<\/p>

                  \u2013 road blockages (falling trees, rocks, chain collisions), landslides near the road;<\/p>

                  \u2013 bridge collapses, blockages of mountain tunnels, train derailments near the road, natural blockages, unauthorized strikes, spontaneous regional riots, unfavorable weather conditions for the smooth running of the proposed itinerary;<\/p>

                  \u2013 natural causes: earthquakes, cataclysms, devastating storms, tornadoes, natural fires, floods, river overflows, riverbed abandonment, etc.;<\/p>

                  \u2013 human causes: state of war, state of siege, forced nationalization (transfer to state ownership), revolutions, popular uprisings, etc.;<\/p>

                  \u2013 non-compliance with orders by suppliers and third parties.<\/p>

                  12.Acceptance<\/h1>

                  Acceptance will be made when the Goods comply with the technical characteristics stated in the Order. If the Buyer discovers that the Products delivered do not comply with the technical specifications, then the Seller will bring the Products into compliance. Also, for products sold and delivered by\u00a0SC SXP WINTER SRL<\/strong>, The buyer benefits from the return of products within 14 days.<\/p>

                  \u00a0<\/p>

                  13. Transfer of ownership<\/h1>

                  Ownership of the Goods will be transferred upon delivery, after payment has been made by the\u00a0buyer<\/strong>\u00a0at the location indicated in the order (meaning delivery \u2013 signing the receipt of the transport document provided by the courier or signing the receipt on the tax invoice in the case of deliveries made by staff)\u00a0seller<\/strong>). In the case of delivery by courier, it is not authorized by\u00a0Seller<\/strong>\u00a0to allow\u00a0buyer<\/strong>\u00a0opening the packages before signing for delivery, but only after signing for delivery and paying any corresponding value.<\/p>

                  \u00a0<\/p>

                  14.Return of products<\/h1>

                  The buyer may request the return of products in the following situations:<\/p>

                  The packages show severe damage;<\/p>

                  The products were delivered \/ invoiced incorrectly. The delivery of products other than those requested must be reported immediately. The buyer can request its return for replacement, and if the product is no longer in stock, he can opt for replacement or full refund of the value. If the replacement with a product of a higher value is agreed, he will pay the difference, respectively if the value is lower, he will receive a partial refund up to the value of the replacement product. The return and shipping costs for the replacement product, if applicable, are borne by the customer.<\/p>

                  The products have manufacturing defects;<\/p>

                  The Buyer has the right to notify the Seller in writing that he\/she withdraws from the purchase, without penalty and without giving any reason, within 14 days from receipt of the product. Also, in accordance with art. 7 par. 1 of OG 130\/2000, the Buyer has the right to unilaterally terminate the distance contract, in writing, within 14 days from the date of receipt of the product\/products, without penalty and without giving any reason. In this case, the direct costs of returning the products will fall, according to the law, on the Buyer's responsibility.<\/p>

                  Products must be returned in their original packaging, with the invoice attached, and must not show any signs of physical wear or damage.<\/p>

                  Custom products cannot be returned. Please note that these products are created to your specified configurations, so they cannot be exchanged or returned.<\/p>

                  If the replacement with a product of a higher value is agreed, the Buyer will pay the difference, or if the value is lower, he will receive a partial refund up to the value of the replacement product. The return and shipping costs for the replacement product, if applicable, are borne by the Buyer. If the products whose return is requested have damaged or incomplete packaging, signs of wear, scratches, bumps, we reserve the right to decide to accept the return or to withhold an amount, the amount that will be communicated after assessing the damages caused.<\/p>

                  In the event of exercising the legal right to return the product, the reimbursement of its value will be made by bank transfer to the account indicated by the Buyer within 14 days of receiving the returned product.<\/p>

                  15. Processing of personal data<\/h1>

                  In order to ensure compliance with the right of site users to the protection of personal data, we have implemented specific protection measures, taking into account Romanian legislation, as well as the requirements established by Regulation (EU) 2017\/679 \u2013 applicable throughout the European Union as of May 25, 2018 (\u201cGDPR\u201d).Regulation<\/strong>").<\/p>

                  Personal data is any information by which you can be identified, in particular by an identifier such as a name, an identification number, location data, an online identifier or one or more elements related to your physical, physiological, genetic, mental, economic, cultural or social identity.<\/p>
