If you are a participant or sign as a legal representative for a minor and want to benefit from the services and activities carried out in the "Straja Extreme Park" adventure park, please pay attention to this document and familiarize yourself with the winter activities. Accidents are a normal and expected part of skiing or snowboarding, and if you don't have the necessary skills for the activities at this park please be advised that Straja Extreme Park offers introductory lessons for beginners. The slope will not be traversed until the camp instructors decide that the participant has/or has acquired the necessary skills to descend safely. DISCLAIMER AGREEMENT.

THE PARTICIPANT AND HIS/HER LEGAL REPRESENTATIVES (IF APPLICABLE) DECLARE THAT THEY UNDERSTAND TO WAIVE THE RIGHT TO CLAIM COMPENSATION OF ANY KIND AS A RESULT OF AN ACCIDENT OCCURRING WITHIN OR IN CONNECTION WITH "STRAJA EXTREME PARK" ACTIVITIES

PLEASE READ CAREFULLY!

Straja Extreme Park, SC TAHO MOUNTAIN SRL and their directors, officers, employees, agents, independent contractors, subcontractors, representatives, successors and deputies and all organizers, officials, workers, volunteers, promoters and advertisers involved in Straja Extreme Park (all hereinafter collectively referred to as the "exempt persons").

DEFINITIONS

In this Exemption Agreement, the term "snow sports" shall include all activities, events, services or use of facilities provided, arranged, organized or conducted by exempt persons, including but not limited to: skiing, snowboarding, sledding, any snow sliding sport, activities carried out by Straja Extreme Park instructors, competitions and demonstrations events, large competitions, ski/snowboard courses and races and all other related activities, events and/or services.

ASSUMPTION OF RISKS

Accidents are a normal and expected part of snow sports. Most of the activities within the Straja Extreme Park camps take place on steep terrain and features that are both physically and technically challenging and will expose the skier to many risks and dangers. These include, but are not limited to: use of chairlifts and gondolas, changing weather conditions, mechanical equipment failure, falls, loss of balance, high speed descents, difficulty or inability to control speed and direction, rapid or uncontrolled acceleration on hills and slopes, extreme variations in ski slopes, including steep or slippery sections, trees, roots, tree stumps, logs, rocks, boulders, rock chips, gravel, holes, depressions, rivers and streams, snow. built elements such as bridges, ramps, stairs, lifts, collisions with natural and built objects, other skiers, vehicles, pedestrians, spectators and officials, encounters with domestic and wild animals including dogs and bears, negligence of other skiers or users of premises, and negligence on the part of exempt persons. I understand that negligence includes the failure of exempt persons to take reasonable steps to save or protect me from the risks and dangers of snowshoeing.

SAFETY

I was advised to wear a helmet and other protective equipment. The use of a helmet is mandatory in the Straja Extreme Park camps.

COMPETITIONS

I recognize that the risks and dangers of snow sports are increased during competitions and contests due to the competitive nature of the activity and the fact that there will be other participants.

I AM AWARE OF THE RISKS AND DANGERS ASSOCIATED WITH THE ACTIVITIES DURING THE CAMPS AND I VOLUNTARILY ACCEPT AND ASSUME ALL RISKS AND DANGERS, INCLUDING THE POSSIBILITY OF PERSONAL INJURY, PROPERTY DAMAGE OR LOSS RESULTING THEREBY.

DISCLAIMER, WAIVER AND INDEMNIFICATION AGREEMENT

In consideration of my participation in Straja Extreme Park camps and activities and the use of services, equipment and facilities of Straja Extreme Park, but also for other good and valuable considerations, the receipt and sufficiency of which is acknowledged, I agree as follows:

1. I waive all claims that I have or may have in the future against the "released persons" and release them from any liability for any loss, damage, expense or injury, including death, that I or my relatives may suffer in following participation in activities, for any reason whatsoever, including negligence, breach of contract or breach of any statutory or other duty, including any duty of care owed under liability law, by "exempt persons". I understand that this negligence also includes the failure of "exempt persons" to take reasonable steps to defend against or protect against the risks of the winter sports hazards mentioned above.
2. To hold harmless and indemnify the "released persons" from any liability and for any material damages, losses or personal injuries to any third party resulting from my participation in the camps.
3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, associates and representatives in the event of my death or incapacity.

In entering into this Release Agreement, I am not relying on any oral/written representations or statements made by the "Released Persons" regarding the safety of snow sports other than those set forth in this Release Agreement.

I confirm that I have read and understood this Release Agreement before signing it and I am aware that by signing it I am waiving certain legal rights that I or my heirs, next of kin, executors, administrators and representatives may have against "persons exempt".
